Government imposes restrictions on the use of ‘Dark Pattern’ on e-commerce platform

The government has taken a big decision to protect consumers from scam in the market. For this, the government has banned the use of dark patterns used in various e-commerce platforms. It has been banned as it creates illusion for consumers to choose the product of their choice.

A notification has been issued in this regard. The Central Consumer Protection Authority has issued a notification. This Gazette Notification is applicable to all platforms offering goods and services. This rule will apply even to advertisers and sellers.

By using dark patterns, customers are enticed to buy something. This includes misleading advertising and unfair trading practices and violation of consumer rights. However, in case of violation of this rule, penalty may be imposed as per the Consumer Protection Act.

Consumer Affairs Secretary Rohit Kumar Singh said, “While digital commerce is increasing, the use of dark patterns has also increased. Various platforms use this to mislead customers based on their preferences and usage. However, as per instructions, any such action or user interface design pattern etc. to mislead the customer is called dark pattern. But now the government has issued a ban order on it. Violation of the rules may result in fines and penalties.
