Supreme Court Orders Removal of Religious Structures from Public Spaces for Safety

The Supreme Court has ordered the removal of religious structures in public spaces to ensure public safety. The court emphasized, “The safety of people is paramount. Religious structures, including temples, mosques, dargahs, and churches, must be demolished if they occupy public areas like roads or railway tracks.”

Reiterating India’s secular stance, the court stated that these directives apply to all religions and must not obstruct public activities.

This ruling follows bulldozer actions in states like Uttar Pradesh, initiated by appeals from groups like Zamiyat Ulema-i-Hind. On September 17, the court temporarily halted these operations but allowed the removal of illegal structures.

Today, Justices BR Gavai and KV Viswanathan reviewed the case, permitting the eviction of public structures while ruling that bulldozing cannot occur on private properties. The court clarified that no actions should target individuals—whether accused or not—regarding their homes or private establishments, asserting, “We will issue guidelines on this matter.”
